1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from us. By ordering, you confirm that the information you provide is accurate and that you are authorised to use the payment method submitted.
2. Products and availability
We work hard to describe products accurately, but we do not warrant that descriptions, images, or colours are error-free. Colours may appear differently depending on your screen. Fit guidance is informational and not a guarantee of individual results.
Inventory is limited. We may discontinue or update products at any time. If an item becomes unavailable after you order, we will contact you to offer a substitute or a full refund.
3. Pricing and order acceptance
Prices are listed in Australian dollars unless otherwise indicated, and may change without notice. International customers may see prices converted to local currency at checkout; final charges depend on your card issuer's exchange rate and fees.
We make every effort to display accurate pricing, but errors can occur. If we identify a pricing error after you place an order, we may cancel the order and refund you in full.
Your order is an offer to buy, not a binding contract, until we accept it by sending a shipping confirmation. We reserve the right to refuse or cancel any order, including for suspected fraud.
4. Payments
Payments are processed by Wix, Stripe, or PayPal, depending on the method you select. We do not collect or store full payment card numbers. By providing payment details, you authorise the charge for the full order total, including tax and shipping.
5. Shipping and risk of loss
Shipping terms are described in our Shipping Policy. Risk of loss transfers to you when the carrier accepts the package from us.
6. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that the Australian Consumer Law confers on you and cannot lawfully be excluded.
7. Returns
Our change-of-mind return process is described in our Returns Policy. This is in addition to, and does not limit, your rights under the Australian Consumer Law.
8. Intellectual property
The Contour Club name, logo, copy, product images, and site design are owned by or licensed to Contour Club. You may not copy, modify, or distribute them without written permission.
9. User conduct
You agree not to misuse the site, for example by attempting to access restricted areas, interfering with security features, scraping content at scale, or submitting false information.
10. Disclaimer of warranties
Subject to the Australian Consumer Law and to the maximum extent permitted by law, the site and products are provided “as is” and “as available.” We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the fullest extent permitted by law, and other than for liability that cannot be excluded or limited under the Australian Consumer Law, Contour Club is not liable for indirect, incidental, or consequential damages arising from your use of the site or products. Our total aggregate liability will not exceed the amount you paid for the product giving rise to the claim.
12. Governing law
These Terms are governed by the laws of Victoria, Australia. Any dispute will be resolved in the courts of Victoria, and you consent to their jurisdiction.
13. Changes
We may update these Terms from time to time. Continued use after an update constitutes acceptance of the updated Terms.
